This Privacy Policy explains how Leadscope Services LLC (“Leadscope,” “we,” “us,” or “our”) collects, uses, discloses, accesses, and retains personal information in connection with the Leadscope website, hosted application, subscription, billing, account-administration, and customer-support services collectively referred to as the “Service.”

Leadscope Services LLC is a New Mexico limited liability company. Our mailing address is 2105 Vista Oeste NW, Ste E #2053, Albuquerque, NM 87120, USA.

1. Scope and data roles

The public website, subscription, billing, and account-management systems are administered by Leadscope.

The hosted application is materially hosted, maintained, and technically operated by an independent third-party technology provider referred to in this Policy as the “Application Provider.” The Application Provider may also provide technical customer support under Leadscope branding.

For personal information used to administer the Leadscope website, subscriptions, billing, customer relationships, and direct support communications, Leadscope generally determines the purposes and means of processing and therefore generally acts as a controller or business under applicable privacy law.

For contact lists, campaign information, messages, Connected Account information, and other information that a customer submits to or processes through the hosted application, the customer generally determines why and how the information is used. Depending on the applicable law and activity:

  • The customer may act as the controller or business;
  • Leadscope may act as a processor or service provider;
  • The Application Provider may act as a processor, subprocessor, or service provider; and
  • Leadscope or the Application Provider may act as a separate controller for limited activities whose purposes they independently determine, including security, fraud prevention, legal compliance, account administration, and their own business records.

Leadscope does not host the primary application database on the public website’s servers.

Leadscope has administrative access to customer accounts and campaign information through the Application Provider’s agency-management tools. Leadscope does not routinely review Customer Content but may access it where reasonably necessary for billing, account administration, customer support, debugging, security, legal compliance, or enforcement of the Terms of Service.

This Privacy Policy is a notice describing data practices. It is not a Data Processing Addendum, Standard Contractual Clauses, UK transfer addendum, business-associate agreement, or other regulated-data contract.

2. Personal information we collect

The information collected depends on how you interact with the Service.

A. Website and technical information

When you visit the public website or account-management pages, we or our providers may collect:

  • IP address;
  • Browser type and version;
  • Device and operating-system information;
  • Referring and requested pages;
  • Date and time of access;
  • Session and cookie identifiers;
  • Approximate location derived from IP address;
  • Security and fraud-prevention information;
  • Server, application, and error logs; and
  • Information about interactions with the website.

B. Account and subscription information

We may collect:

  • Name;
  • Business email address;
  • Company or organization name;
  • Mailing or billing address;
  • Account identifiers;
  • Subscription plan and status;
  • Billing interval;
  • Invoice and payment history;
  • Payment status;
  • Cancellation information;
  • Customer-support history; and
  • Limited payment-method information supplied by the payment processor, such as card brand, expiration information, transaction identifier, or the last four digits.

Full payment-card details are submitted directly to Stripe or another payment processor. Leadscope does not intentionally receive or store complete payment-card numbers.

C. Customer Content and campaign information

The hosted application may process Customer Content submitted by or generated for a customer, including:

  • Contact and prospect lists;
  • Names, business email addresses, professional details, company information, and other business contact information;
  • Business contact or professional information supplied by a customer, imported from a customer-selected source, or returned by an application feature;
  • Search criteria, filters, imported files, URLs, and campaign settings;
  • Message templates and message content;
  • Sent and received messages;
  • Replies and communication history;
  • Campaign events, status, results, and performance information;
  • Suppression, opt-out, and unsubscribe information;
  • Exports and reports;
  • Customer instructions and application settings; and
  • Usage, security, debugging, and audit information.

Leadscope does not independently select the recipients, content, or targeting of a customer’s campaigns.

D. Connected email accounts and authentication information

Customers may connect email accounts and other third-party services to the hosted application.

Depending on the selected connection and functionality, the Application Provider may process:

  • Email address and account identifier;
  • Email-provider information;
  • OAuth authorization tokens;
  • Application-specific passwords or other supported authentication information;
  • Mailbox and sending configuration;
  • Message headers, content, attachments, and metadata;
  • Sending and delivery information;
  • Replies and inbox information;
  • Account status and error information; and
  • Other information necessary to provide the customer-selected functionality.

When OAuth is used, the Application Provider generally receives an authorization token rather than the underlying email-account password. Leadscope generally does not receive the underlying email-account password.

Customers may revoke or disconnect a Connected Account through the application or the applicable email provider where that functionality is available. Disconnecting an account stops future access to the extent technically supported but may not automatically delete prior messages, campaign history, logs, or other information already processed.

E. Support and correspondence information

We may process:

  • Emails and other communications sent to Leadscope;
  • Customer-support requests;
  • Cancellation and billing requests;
  • Screenshots, files, and attachments a customer chooses to provide;
  • Technical information required to reproduce or investigate an issue;
  • Records of responses and resolutions; and
  • Communications with the Application Provider or other providers concerning the customer’s issue.

F. Security, compliance, and legal information

We may process information reasonably necessary to:

  • Authenticate users;
  • Investigate suspected unauthorized access, fraud, or abuse;
  • Enforce the Terms of Service;
  • Respond to complaints;
  • Document consent, cancellation, account status, or customer instructions;
  • Establish, exercise, or defend legal claims;
  • Comply with applicable law, legal process, or governmental requests; and
  • Preserve information subject to a legal hold.

3. How we receive personal information

We may receive personal information:

  • Directly from you;
  • From your employer or organization;
  • From Stripe or another payment processor;
  • From the Application Provider;
  • From Connected Accounts and customer-selected integrations;
  • From website, hosting, security, and email-service providers;
  • Automatically from your browser, device, or use of the Service;
  • From customer-support and business-communications systems; and
  • From other persons who contact us about an account, campaign, message, legal issue, or privacy request.

4. How we use personal information

We may use personal information to:

  • Create and administer accounts;
  • Provide subscription access;
  • Authenticate users;
  • Process payments and maintain transaction records;
  • Operate, maintain, support, and secure the Service;
  • Carry out customer-selected settings and instructions;
  • Connect and operate customer-authorized email accounts and integrations;
  • Deliver customer-selected messages and process replies;
  • Provide account, billing, and technical support;
  • Debug application and campaign issues;
  • Process cancellation, data-export, disconnection, and deletion requests;
  • Detect, investigate, and prevent fraud, misuse, abuse, and security incidents;
  • Enforce the Terms of Service;
  • Comply with law and legal process;
  • Establish, exercise, or defend legal claims;
  • Maintain tax, accounting, and business records; and
  • Communicate billing, account, service, security, privacy, and legal notices.

Where EU or UK data-protection law applies, the legal basis may include:

  • Performance of a contract;
  • Steps requested before entering a contract;
  • Compliance with a legal obligation;
  • Legitimate interests in operating, administering, supporting, and securing the Service and protecting legal rights;
  • Consent where legally required; and
  • Establishment, exercise, or defense of legal claims.

When Leadscope processes Customer Content solely on a customer’s behalf, the customer is responsible for determining and documenting the applicable lawful basis.

5. How personal information is disclosed

We may disclose personal information to the following recipients or categories of recipients where reasonably necessary.

Hosted Application Provider

The Application Provider hosts and technically operates the hosted application and may process Customer Content, campaign information, Connected Account information, authentication information, support information, application usage information, and security information.

The Application Provider may use cloud-infrastructure, database, monitoring, communications, and other technical providers to operate the hosted application.

Stripe and payment providers

Stripe and other payment providers process payment information, recurring charges, refunds, disputes, and transaction records.

Website and infrastructure providers

Namecheap and related hosting providers may process website, account-management, server-log, and technical information.

Cloudflare may process IP addresses, device and browser information, request information, security signals, and other technical information for content delivery, security filtering, and performance.

Email and communications providers

Brevo and other communications providers may process names, email addresses, account identifiers, and message content to deliver transactional, account, billing, support, security, and legal communications.

Business-communications and support providers may process information needed to coordinate customer support and technical resolution with the Application Provider.

Connected services

When a customer connects an email provider or another third-party service, information is transmitted to or received from that service as directed by the customer. The connected service’s own terms and privacy practices apply to its independent processing.

Professional advisers

We may disclose information to lawyers, accountants, tax advisers, insurers, auditors, consultants, and other professional advisers where reasonably necessary.

Legal and protective disclosures

We may disclose information where reasonably necessary to comply with law, legal process, a court order, or a governmental request, or to protect the rights, safety, security, and integrity of Leadscope, the Service, customers, or other persons.

Business transfers and closure

Information may be transferred, disclosed, returned, or deleted in connection with a merger, financing, reorganization, asset sale, acquisition, bankruptcy, dissolution, closure, or transfer of all or part of the Service.

6. Sale, targeted advertising, and sensitive information

Leadscope does not sell personal information for money.

Leadscope does not use personal information for cross-context behavioral advertising or targeted advertising based on activity across unrelated businesses or services.

Authentication information, Connected Account tokens, and similar security information are used only as reasonably necessary to provide, secure, troubleshoot, and administer the Service or comply with law. Leadscope does not use that information to infer characteristics about individuals.

Customer-directed processing, processing by service providers to operate the Service, and transfers to customer-selected Connected Accounts are not undertaken for advertising purposes.

7. Customer responsibilities for Customer Content

Customers are responsible for personal information they submit to or process through the Service.

A customer must:

  • Have the rights, authority, notices, consent, permission, or other lawful basis required to collect and process the information;
  • Provide all legally required privacy notices;
  • Honor legally valid access, correction, deletion, suppression, objection, and opt-out requests;
  • Avoid submitting highly sensitive or regulated information unless Leadscope has approved that use in writing; and
  • Ensure that its instructions to Leadscope and the Application Provider are lawful.

Where Leadscope receives a privacy request concerning Customer Content controlled by a customer, Leadscope may direct the requester to that customer, forward the request to the customer, or assist the customer where reasonably possible and legally required.

8. International processing

Leadscope is based in the United States.

The Application Provider is based outside the United States, and the Service and its providers may process information in the United States, the United Kingdom, the European Economic Area, and other countries where the Application Provider or its infrastructure providers operate.

Those countries may have privacy laws that differ from those where an individual resides.

The transfer mechanism and contractual documentation required for a particular use depend on the locations of the customer, the individuals involved, Leadscope, the Application Provider, and other providers, as well as the parties’ respective legal roles.

If a customer’s use requires a Data Processing Addendum, Standard Contractual Clauses, UK transfer addendum, or another international-transfer mechanism, the customer must contact [email protected] before submitting the affected information so that the applicable documentation and requirements can be evaluated.

This Privacy Policy does not itself represent that a particular transfer mechanism applies to every customer or every use of the Service.

9. Retention, disconnection, and deletion

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, considering:

  • The duration of the account and subscription relationship;
  • The need to provide and support the Service;
  • Account closure, export, and deletion requests;
  • Security and fraud-prevention needs;
  • Applicable statutes of limitation;
  • Tax, accounting, and recordkeeping obligations;
  • Provider retention and backup practices; and
  • Legal holds and legal claims.

Account, billing, subscription, invoice, tax, refund, dispute, and transaction records may be retained for up to seven years after the relevant transaction or account closure, or longer where required by law or reasonably necessary for a legal claim.

Support and correspondence records are retained for as long as reasonably necessary to respond, maintain an appropriate business record, resolve disputes, and comply with legal obligations.

Customer Content is generally retained in the hosted application while the applicable account remains active and for a reasonable period needed to process closure, export, recovery, security, and deletion.

A customer may disconnect a Connected Account at any time through the application or connected provider where available.

For Customer Content that cannot be deleted directly by the customer, the customer may submit a deletion request to [email protected]. After verifying the request, Leadscope will submit the applicable deletion instruction to the Application Provider.

Because the Application Provider controls the primary application systems, databases, logs, and backups, deletion timing depends on the Application Provider’s technical capabilities, backup cycles, security requirements, legal obligations, and any applicable legal hold.

Information stored in backups may remain isolated from ordinary use until the backup is overwritten or destroyed under the applicable provider’s retention process.

10. Security

Leadscope takes reasonable administrative and technical steps designed to protect personal information appropriate to Leadscope’s role and the nature of the information.

Those steps include limiting administrative access to persons who require it for account administration, billing, customer support, debugging, security, or legal compliance.

The hosted application’s technical security, primary infrastructure, databases, authentication systems, and backup systems are materially controlled by the Application Provider and its infrastructure providers.

No website, application, transmission, or storage system can be guaranteed completely secure.

Customers are responsible for protecting their account credentials, devices, Connected Accounts, OAuth authorizations, and other authentication information and for promptly notifying Leadscope of suspected unauthorized access.

Where required by applicable law, Leadscope will provide legally required security-incident or data-breach notifications.

11. Cookies and similar technologies

The public website and account-management pages use cookies and similar technologies for:

  • Website security;
  • Fraud and abuse prevention;
  • Session management;
  • Account login;
  • Subscription and billing functions;
  • User preferences; and
  • Technical operation and error handling.

WordPress, WooCommerce, Cloudflare, Namecheap, and related providers may set cookies necessary for those functions.

The hosted application may use cookies and similar technologies set by the Application Provider for authentication, security, support, application functionality, preferences, and limited service-usage measurement.

Leadscope does not intentionally use the public website’s cookies for cross-context behavioral advertising.

Where applicable law requires consent before a non-essential cookie or similar technology is used, Leadscope will request that consent before enabling the technology.

You may block or delete cookies through your browser settings, although doing so may prevent parts of the website or application from functioning properly.

12. Privacy rights

Depending on where you live, the nature of the information, and the law applicable to Leadscope, you may have the right to:

  • Request access to personal information;
  • Request correction of inaccurate information;
  • Request deletion;
  • Request a portable copy;
  • Restrict or object to certain processing;
  • Withdraw consent where processing is based on consent;
  • Opt out of certain sales, sharing, targeted advertising, or profiling;
  • Appeal a denied privacy request where applicable; and
  • Complain to an applicable privacy or data-protection authority.

We may need to verify your identity, account, or authority before completing a request. We will respond within the period required by the law that applies to the request.

An authorized agent may submit a request where permitted by law, but we may require evidence of the agent’s authority and may verify the individual’s identity directly.

We will not discriminate against a person for exercising a privacy right granted by applicable law.

If a request concerns Customer Content controlled by one of our customers, the request should ordinarily be directed to that customer. Leadscope may forward the request or assist the customer as appropriate.

13. Children

The Service is intended solely for business and professional use and is not directed to children.

Leadscope does not knowingly collect personal information directly from children under 16 through the website or subscription process.

Customers may not knowingly submit information about children through the Service unless Leadscope has expressly authorized that use in writing and all applicable legal requirements have been satisfied.

14. Third-party services

Third-party websites, email providers, Connected Accounts, payment providers, integrations, and other services have their own terms and privacy practices.

Leadscope is not responsible for a third party’s independent privacy practices. You should review the terms and privacy information supplied by each third party you choose to connect to or use with the Service.

15. Changes to this Policy

We may update this Privacy Policy to reflect changes in the Service, our providers, applicable law, or our actual data practices. We will update the “Last updated” date above when changes are made.

Where a change materially affects how we collect, use, or disclose personal information, we will provide additional notice to active subscribers by email, through the Service, or through another reasonably conspicuous method.

Where required by applicable law, we will obtain consent before applying a materially expanded use or disclosure to personal information collected under an earlier version of this Policy.
